If you asked a physics professor or just about any scientist he would probably tell you yes it is fact because it can not be proven wrong. Science works in weird ways when it comes to how theories, laws, and facts are explained. So pretty much you're not wrong if you think it's not a fact but you're not wrong if you think it is either.
