But you can't...say lock him out, change the locks?
legaly no. i have been fighting with that for the longest time... the laws in NC are set up to protect the tennants, so they have all the rights. apparently, if you take any of your stuff into someones home, and leave it there, it establishes that place as your residence (and this is not an exageration, this is how it has been described to me by my lawyer, the magistrate, and the sherrifs...). and you are entitled to do whatever you want to your residence, so if i were to change the locks he could legally kick the door in to gain access. so its really not worth me having to replace the door in order to gain nothing.

im just kind of trapped with him, and i have to clean up after him, support him, pay all the utilities, while he lives completely for free... and yeah, he is considered to be a tennant in this situation.

i thought about it, and if i had access to the main breaker outside of my condo i would have killed all the power and shut off the hot water heater. but now that im home all of this would kind of be like cutting off my right hand to spite my left hand...

and i dont want to just leave the house with him in it, there is no telling what kind of damages he would do... i do have his social security number if anyone wants it.

yeah, we went to court, i won and the magistrate got pissed at him because he lied under oath. he owes me money, hasnt paid, today was supposed to be his last day, but apparently there are more processes that i have to go through and i have to wait for the sherriff to actually come and remove him... which could be next week... but i guess on the plus side i will be home for all of this to protect my stuff.
everything has been removed from the common area, he has no tv to watch down here, no silverware to eat with, no computer to use, nothing... all he is able to do is watch tv in his room, and he has no cable in his room. the laundry machines have also been disabled so he cant do his laundry here. he works at night, and sleeps during the day, well not anymore, i am at home listening to music at my prefered volume level //content.invisioncic.com/y282845/emoticons/smile.gif.1ebc41e1811405b213edfc4622c41e27.gif , which is not quiet. also, there is some work going on outside of my home at the moment and he has refused to move his car, so there is a tow truck on the way to tow the truck at his expense.

the paperwork has been filed for the sherrif to come and remove him, but like i said, that will most likely be next week. but that will leave him homeless for a while as he has not made any effort to find a new place... i am hoping that the sherriff can force him to pay me what was owed to me from the court settlement as well, but i have a feeling they wont be able to do that. and i actually called him a worthless ****** to his face. he didnt deny it.
yeah i remember all that. The sherrif cannot make him pay. and that 24hour thing where if someone is in your house puts stuff there and calls it their home, is true almost everywhere, well at least on the eastcoast that I have experienced. Thats why you cant have shdy tenants because they can move in, pay the security deposit, then not pay a dime after that, and have your house for 3+ months

i dont think he does. he bluffed about having a lawyer before. i think he is to lazy/not smart enough to figure those kinds of things out.
also, just to clarify, i used the phrase to describe an individual, not a race.

this is what i would do, but i am a dickheaded ******* piece of shit when it comes to stuff like that. I would have terrorized my tenants if they had pulled some shit like this on me. And if someone tried to jsut squat in my house and not leave, he just get beat down until he left. mhay sound tough guyish, but the legal process is bullshit for this type of thing.

It seems like he is already doing that. I think the other fellow is just being stubborn.
moar stuff should be done. I would do your thing, turn off electric, water and move out.

I bet he didnt take a dump in his bed though.
