    Also told me it is most likely a joint fail with the collar and glue

    Without meaning to defend the guy, don't even recognize the screen name. If he listed them as BNIB, that means brand new in box, He may very well not have been aware there was an issue with the subs. Was there any indication that they had been mounted previously? Usually you can tell if they have.
