Court is a waste of time IMO.. You'll just be out more time and expense.. If you want to make the best use of your time and expenses, then stick with the road trip with your buddies.. That will get things settled the quickest, and you can be guaranteed something for your troubles, maybe even more than he owes you.. I'm not one to condone violence, but this has gotten ridiculous, and he's had many opportunities to come clean.. I think a face to face meeting is in order..

It's ****** that it even has to come to this, but it's so easy for ppl to hide behind their computers.. It's always easier to get things settled face to face when they have no place to hide.. Good luck with with whatever you decide to do..

    Re: Kngofthepknglot We Got Problems!!!

Ya I got the lawyer for free it is my dads.
He had him before he was a retired RCMP officer.
Him and his familly still have full access to him and already spoke and there are alot of charges I can press. You would not belive half of them. I was like wtf.

Road trip is still on. Not going to tell when cause that way Rob can take off and not be around. All my Boys that are coming with me already got the ok for vacation from there jobs.

Like I said before we got a camcorder and will have alot of videos of stuff that we do on our trip and kings face when we knock on his door.

    Re: Kngofthepknglot We Got Problems!!!

just so you know the point of small claims court is that you can settle small disputes without having lawyers. basically it gives you a chance to have a direct go at the client and he just cant scare you away with a extremely expensive lawyer. So long as the claim isn't over a certain amount.. (I think 5k) Also, is there anyone else that got scammed? if the value of the items adds up high enough then he could actually be arrested... Again though, I don't know how much it has to be before it becomes a actual crime and not a civil dispute.

if you're going to use a lawyer then what are you going to see him for, he'll prob just keep his door closed and call the cops, and if you plan on doing anything past that then your case isn't going to look as good in court

What I was trying to say is that as far as I know lawyers are not allowed in small claims. Defeats the point. you can get your advice from them but thats about it for small claims... Ever see a show called Judge Judy... Thats how small claims works. Just without the TVs and the attitude.

No, if he has no money you may not be able to immediately get any cash out of him. However, after a judgment is rendered that he does, in fact, owe a debt of X amount of dollars to you you'll then be able to secure a judgement of seizure which will take any tangible, movable assets until another court date. (like his car, his wife's car, whatever he has of any value) At that second court date if he does not produce the money he owes in full they start selling off his stuff until enough $$$ is rasised to satisfy the debt.

I don't know, however, if the potential travel that might be necessary to pursue this would be worth it...
I am not a lawyer, and do not want to get into a legal debate, but there are certain things that will be off limits if such an "auction" were to take place to recover costs. My point being, I don't think he is sitting on a wad of cash to pay the $$ back, and if no cash, why would he hold much else of value to auction off. I could be completely wrong, but I would say file whatever you "free" lawyer recomends, but don't put out any more cash, because I doubt you will see a dime of it come back.

    Re: Kngofthepknglot We Got Problems!!!

FYI: The road trip to "bash his face in" is not a good idea either. Then you will end up with criminal charges against you, and give him grounds for a nice civil suit. Then your $400 (or whatever) blown sub turns into a multiple thousands judgement against you.

He has to leave his house doesnt he?
Not saying we are going down there to kick his head in just have a friendly chat with the ****er that ripped me off.

I cant get answers here so why not pay him a visit?
He wont call me or come on here and say anything.

My boys wanted to go somewhere on vacation anyways so why not NY?
We never been there have not been out of canada for that matter and it is only a 6 hour drive or so.
Maby catch a ball game or something.
Anyone recomend something to do while we are down there, stuff to see ect...

Again our plans are not to kick his teeth down his throat but to get some strait answers that way he can not lie and hide behind his computer.

I am well aware certain things would be off limits to a property seizure order. His car isn't one of those things. I reckon that alone could be sold off for at least the $400 that is owed, don't you? Or does he drive such an incredibly raggedy POS that it wouldn't even bring $400 if sold???
