i think king decided the guy who sent him the one that fried his amp was never getting it back. A long time ago.. like before any of this crap.. before his house was robbed.. everything..

i remember having a conversation with him about it..

he figured he was out an amp.. the guy was out a sub...

i told him it would probably cost him his rep here in the forums... he was the onyl one who could decide what that was worth... I was surprised i never saw any complaints about it until this thread.. i expected who ever lost that MT to get pissed.. but it never happened.

I really dont think his house was robbed I just dont belive a word that comes out of his mouth.

He told the other guy waiting on his mt that he was moving and that is why he could not wait for ups to pick up the sub and didnt have time to drop it off.

He lied again right there.
He did not move I gave the police that address and they went there and he was still there with no signs of moving.

Here is what the police said.

Jeremy, I spoke with Robert Fox again on this and about the emails on the shipping. He stated there were also phone conversations on this and about the shipping and he stated you were ok with usps.

Ya I called you and it was from western union to make sure you would ship the sub on the way home and make sure you got the extra money you told me you needed for shipping.
There was not ****ing phone call that said anything about it was ok with me for you to rip me off on shipping and send it usps with no insurance. how ****ing dumb do you think I am.

The case would still be a civil case and could be pursued in small claims court. . The City Court phone # is 315-363-1310, they could better answer your questions on small claims court action. If the speaker can be repaired you may want to check with R Fox to see if he would cover half rather than a civil action. .

I would ask him to pay atleast half so it is not a total loss but kind of hard when he has not been on here for well over a week.

So I am left with no other option but to file the charges and get my money back and then some.

Rob I tried to give you a chance to be a good guy about this and everyone makes mistakes but you went out of you way through this whole deal and did nothing but lie and take me for everything you could.

Ya Right now I would take half of the recone cost which is about 150 us.

200 Canadian for recone
about 50 dollars each way for shipping to the canadian Re retailer to have him recone it.

So total of 300 and I would split the cost on this just to be done with it.
If not like I said charges have been filed and the wheels are turning.
You have 24 hours to contact me and make arragements to at least give me half the recone and nothing less or you will be hearing from my lawyer.

This is really sad it has to come to this but you are leaving me with no other options.

IMO, if you can't get $$$ out of him, small claims court won't either. You can higher a lawyer, pay more out of pocket, and pursue it, but IIRC it will only hold a judgement against him. The judgement won't really due anytihng (realistically, theoretically it means you won and he owes the sub money plus lawyer fees), but I honestly don't think you will see it.

Even if he dont got a job now they will when he gets one.
So in the long run I will get my money back. might be a few months from now after the court thing is over but I will atleast have the satisfaction of getting my money back and showing the public that you can't just rip people off and get away with it.

That's not entirely true. You can go through the process, do small claims court (but I'm not sure where it would have to happen...in Canada or where King is...) and secure the judgement. No, if he has no money you may not be able to immediately get any cash out of him. However, after a judgment is rendered that he does, in fact, owe a debt of X amount of dollars to you you'll then be able to secure a judgement of seizure which will take any tangible, movable assets until another court date. (like his car, his wife's car, whatever he has of any value) At that second court date if he does not produce the money he owes in full they start selling off his stuff until enough $$$ is rasised to satisfy the debt.

I don't know, however, if the potential travel that might be necessary to pursue this would be worth it...
